Is Prop Trading Legal in Kenya?

No Kenyan law makes it an offence to buy an evaluation account and trade it. The licensing duty under the Capital Markets Act falls on firms doing business as brokers, not on the trader.

Kenya is still a tighter market than most, and the reason has less to do with legality than with what happens if something goes wrong. This is general information, not legal or tax advice.

The Licence Requirement Sits on Brokers

Section 23(1) of the Capital Markets Act makes it an offence to carry on business as an online foreign exchange broker without a licence. The Capital Markets Online Foreign Exchange Trading Regulations of 2017 set out how that works.

The CMA has licensed very few firms under it. A short list of non-dealing online forex brokers, plus a money manager licence. The register takes two minutes to check.

A funded account programme is usually not broking at all. You pay a fee, trade a simulated account under written rules, and take a share of the result. No client funds change hands.

So is prop trading legal in kenya is a question about a firm’s business, not your conduct. Nothing in the Act makes you an offender for holding an account with an unlicensed foreign company.

What the CMA Warnings Mean for You

The CMA has issued cautionary statements telling unlicensed offshore firms to stop onboarding Kenyan clients and stop promoting to Kenyan investors. That is a more active position than most European regulators have taken.

Read the part about your side carefully. The CMA’s own language is that investors using unlicensed platforms risk losing their money and may not be protected by the law.

That is the real exposure, and it is not criminal. It is the absence of recourse. If a firm stops paying, rewrites its terms or disappears, no Kenyan regulator has jurisdiction over it and no compensation scheme sits behind it. You hold a contract with a foreign company, and that contract is the whole of your protection.

The CMA Fraud Investigation Unit is where complaints go. Worth knowing before you need it.

Tax Is Services Income, Not a Capital Gain

This one gets handled badly in Kenyan trading forums.

A payout is not a capital gain and capital gains tax does not apply to it. You are not selling an asset you owned. You are paid a share of a result you produced on someone else’s capital, which makes it compensation for a service.

Kenyan residents are taxed on income from services performed in or outside Kenya, so a firm registered in Dubai or London does not put a payout out of scope. If the work happened at a desk in Nairobi, it counts.

That puts it into graduated income tax, running from 10 percent up to 35 percent at the top band, and it has to be declared on your return. Whether you register as a business, and what you deduct against it, depends on scale.

Settle that with a registered tax practitioner before your first withdrawal, not in June.

Conclusion – Is Prop Trading Legal in Kenya?

Is prop trading legal in Kenya is a yes with a caveat that carries more weight here than elsewhere. Trading the account is not an offence. The licensing rules mean the firm you pick sits outside Kenyan protection, so the written terms and the payout record do the job a regulator would do in another market.

FAQ – Is Prop Trading Legal in Kenya?

1. Do I need a CMA licence to trade a funded account?

No. The licence requirement applies to firms carrying on business as online forex brokers, not to a trader using an account owned by someone else.

2. Can the CMA help me if a prop firm refuses to pay?

Realistically no, where the firm is offshore and unlicensed. You can report it to the CMA Fraud Investigation Unit, but there is no Kenyan jurisdiction over a foreign company and no compensation scheme to claim from.

3. Do I pay capital gains tax on prop firm payouts?

No. A payout is compensation for a service, not a gain on an asset you held. It falls under graduated income tax and needs declaring. Confirm your position with a registered tax practitioner.
