Is Prop Trading Legal in Germany? A 2026 Overview

Short answer first. Nothing in German law prohibits a resident of Germany from buying an evaluation account and trading it. Traders in Frankfurt, Berlin and Munich do it every day without breaking anything.

The detail is where it gets useful. This is general information rather than legal or tax advice, and the second half is the part worth taking to a professional.

There Is No Prop Firm Law in Germany

German financial regulation is activity based. BaFin does not license business models, it licenses activities. Proprietary trading, Eigenhandel under the Banking Act, is one of those licensable activities when a firm deals on its own account in a particular way.

The evaluation model does not sit neatly inside any existing category. A trader pays a fee, trades a simulated account, and receives a payout based on performance. No client money is held. In most structures no third party assets are managed either.

Rules written for brokers and asset managers do not map onto that cleanly, which is why is prop trading legal in germany keeps getting asked and keeps getting answered vaguely.

What is clear is the trader’s side. Trading an account someone else owns, under their rules, for a share of the result, is not an activity that requires you to be licensed.

BaFin Has Issued Warnings, Which Is Not the Same as a Ban

BaFin has published investor warnings touching this space. Italy’s Consob has done the same. Both are aimed at the leveraged products and the marketing around them rather than at the existence of funded account programmes.

There is precedent. BaFin previously restricted CFDs carrying additional payment obligations and providers restructured rather than disappeared. The regulator went after a product feature, not the category.

Read a warning for what it is. It says the regulator sees consumer risk in high leverage and promotional claims. It does not say you have committed an offence by opening an account.

The Firm Behind the Firm Is Worth Checking

More relevant than the legal question is who is actually executing anything.

Most prop firms are not brokers. They route to one, or they simulate. If a real broker is involved, check the register of whichever regulator licensed it. If the model is fully simulated, what you hold is a contract with a company, and the strength of that contract is your position.

The 2024 to 2026 shakeout removed a number of firms. The ones that survived tended to have clear terms and a payout record. Read the terms before the fee leaves your account.

Tax Is the Question That Actually Affects You

This is the part German residents underestimate.

Prop firm payouts are generally not investment income, because the capital is not yours. They are more commonly treated as income from a service or as business income, and that classification drives everything downstream. Whether you count as private asset management or commercial activity, whether trade tax applies, whether you register a business.

The answer depends on your volume, your setup and your other income. It is a matter for a Steuerberater rather than a forum thread. Backdating a classification across two years of payouts costs far more than one consultation.

Conclusion – Is Prop Trading Legal in Germany? A 2026 Overview

Is prop trading legal in Germany is a question with a straightforward answer attached to a complicated context. You are permitted to trade. The regulator has expressed concern about the products and the advertising. Your real exposure is counterparty risk and tax treatment, and both of those are things you can check before you start.

FAQ – Is Prop Trading Legal in Germany? A 2026 Overview

1. Do I need a licence to trade a funded account from Germany?

No. Trading an account owned by another company under its rules is not a licensable activity for you.

2. Does a BaFin warning mean prop firms are illegal?

No. A warning flags consumer risk. It is not a prohibition, and it is generally aimed at leveraged products and marketing rather than the funded account model.

3. How are prop firm payouts taxed in Germany?

That depends on your circumstances and it is not something to guess at. Payouts are usually not treated as capital gains. Speak to a Steuerberater before your first withdrawal.
